These terms apply to purchases and use of empacsgroup.com, operated by EMPACS Group of Aurora, Colorado (“EMPACS,” “we,” “us”). By placing an order or using the site you agree to them. Orders and pricing

Prices are shown in U.S. dollars and can change without notice, but the price you see at checkout is the price you pay for that order. Quantity discounts, such as 5% off orders of 10 or more cases of ATP products, are applied at checkout as shown on the product pages. We may cancel or limit an order if a product is out of stock, a price was listed in error, or we cannot verify payment; if that happens we will tell you and refund anything already charged.

Some products, including ATP swabs and luminometers, are professional hygiene monitoring equipment. Use them as the manufacturer directs.

Payment

Card payments are processed by Square. Approved business accounts may pay by invoice or purchase order; payment terms for those orders are the terms stated on the invoice. Orders are not shipped until payment is received or credit is approved.

Shipping

ATP consumables ship free by 2-day express, as stated on the product pages. Other products ship at the rates shown at checkout. Delivery dates are estimates. Risk of loss passes to you when the carrier accepts the package; if a package arrives damaged, tell us right away so we can file a claim with the carrier and replace the item.

Returns

Our full Returns and Refunds Policy applies. In short: most items can be returned within 30 days of delivery in new, unused condition and original packaging; hygiene testing kits are not returnable for safety reasons; refunds go to the original payment method after inspection.

Auto-ship

If you set up auto-ship, we will send the product at the interval you chose and charge the payment method on file each time. You can change the interval or cancel from your account or by emailing us before the next shipment is processed.

Accounts

Keep your login private. You are responsible for orders placed through your account. Tell us right away if you think someone else has used it.

Products, brands and warranties

EMPACS Group is an Authorized Distributor of Hygiena. Hygiena, UltraSnap, AquaSnap, SuperSnap, EnSURE, Neogen, Clean-Trace, AccuPoint and other product names are trademarks of their owners and are used here to identify the products we sell. Products carry the warranty their manufacturer provides; EMPACS does not add a separate warranty. To the extent the law allows, EMPACS is not liable for indirect or consequential losses, and our liability for any order is limited to the amount you paid for it. Nothing here limits rights that the law does not allow to be limited.

Site content

Product descriptions, guides and articles on the site are for general information. Test results and thresholds depend on your surfaces, procedures and equipment; confirm them for your own facility. Content on the site belongs to EMPACS or its suppliers and may not be copied for commercial use without permission.

Privacy

Our Privacy Policy explains what information we collect and how we use it.

Governing law

These terms are governed by the laws of the State of Colorado. Any dispute will be handled in the state or federal courts located in Colorado.

Changes

We may update these terms. The date at the top shows the current version. Orders are governed by the terms in effect when the order was placed.
